1. Introduction
Welcome to TOPS. These Terms of Service ("Terms") govern your use of our website www.thetops-store.com and the purchase of our products. By accessing or using our website, you agree to be bound by these Terms.
2. Use of the Website
By using our website, you represent that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the service, violate any laws under the Egyptian jurisdiction.
3. Account Registration
To access certain features of our website, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Orders and Payments
All orders placed through our website are subject to our acceptance. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event of a change to or cancellation of an order, we will notify you by contacting the email and/or billing address/phone number provided at the time the order was made.
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time. We are not liable to you or to any third party for any modification, price change, suspension, or discontinuance of the service.
Custom Orders are subject to a design fee (set within the quote) and may take up to 15 business days in production prior to delivery. Clients who wish to customize a color must send the color code and/or Hex code (Jotun / SCIB) to TOPS Business Team in order to avoid any discrepancies in the product development and execution. In case the client provides a measurement and/or color choice, it is the sole responsibility of the client and not TOPS for the overall product output.
5. Shipping and Delivery
We aim to deliver products in a timely manner. Delivery times may vary depending on your location and other factors. We are not responsible for delays caused by events outside of our control, such as natural disasters or transportation strikes.
Customers who select the Cash on Delivery (COD) payment option are required to make full payment upon receipt of their order. In the event that payment is not completed at the time of delivery, a late payment fee of 250 EGP will be applied to the order total. In the case of continued failure to settle the outstanding balance, TOPS reserves the right to retrieve the item(s) from the delivery address within 72 hours which may result in restrictions on future purchases and/or further legal action.
6. Returns and Refunds
We want you to be satisfied with your purchase. If you are not completely happy with your order, please review our Return and Refund Policy for information on how to return items and receive a refund.
7. Intellectual Property
All content on our website, including but not limited to text, designs, graphics, logos, images, and software, is the property of TOPS or our content suppliers and is protected by international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written permission.
8. Limitation of Liability
To the maximum extent permitted by law, TOPS shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, revenue, or data, arising out of or in connection with your use of our website or the purchase of our products.
9. Indemnification
You agree to indemnify, defend, and hold harmless TOPS and our affiliates, officers, directors, employees, and agents from any claim, demand, or damage, including reasonable attorneys' fees, arising out of or related to your breach of these Terms or your violation of any law or the rights of a third party.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Egypt, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Cairo, Egypt, for the resolution of any disputes arising out of or related to these Terms or your use of our website.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any significant changes by posting the new Terms on our website and updating the effective date. Your continued use of our website following the posting of changes constitutes your acceptance of such changes.
